NON-JURY TRIAL: Broward Electrical Contractor and Owner Held Liable for Money Judgment against Corporate Predecessor. In Miami Center Limited Partnership et al. v. James P. Driscoll, Inc. et al., the firm was lead counsel in proceedings supplementary to execution, which culminated in a week-long trial in February 2006. We established that the sole shareholder of a south Florida electrical contractor (which was liable on a judgment debt to our client for breach of contract and over-billing), as well as the contractor's corporate affiliate, were each the alter egos of the judgment debtor. Additionally, we proved that the corporate affiliate was the "mere continuation" of the business of the original contractor, despite claims that the affiliate's business was fundamentally different than the original contractor's. On these bases, the Circuit Court entered a final judgment of personal liability against both the sole shareholder and the corporate affiliate for the full amount of the judgment with interest, for a total liability of over $8 million, including attorneys' fees and costs. The judgment was affirmed on appeal. James P. Driscoll, Inc. v. Gould, 967 So.2d 369 (Fla. 3d DCA 2007).

SETTLEMENT: Recovery for Sewer Contractor against County. Scott Sheftall represented a Michigan-based sewer contractor which alleged it was still owed over $3 million by Lee County for work it had completed in constructing extensive pipe works. After two years of litigation, Mr. Sheftall reached a confidential settlement with Lee County for an undisclosed sum.

SETTLEMENT: Recovery for Deep Tunnel Excavator in Peruvian Dam Project. In Mine, Shaft & Tunnel, S.A.C. v. Association Skanska-Cosapi-Chizaki, Scott Sheftall prosecuted claims in international arbitration on behalf of an American subcontractor for work it had done preparing to excavate deep shafts in the Andes as part of a major hydroelectric project in Peru. The general contractor, the Association Skanska, countered that the claimant, Mine Shaft & Tunnel, had failed to substantiate its claim for damages. Mr. Sheftall reached a confidential settlement with Skanska's counsel in London for an undisclosed sum.
