There is no end to the variety of contracts which give rise to claims of breach. We undertake to analyze the rights and obligations of the parties at the very outset of the engagement in order to advise our clients of their chances of success in litigation, and then we aggressively move forward into the litigation process when it is in our clients' best interests. In other cases, we may help our clients avoid litigation through negotiation or alternative dispute resolution.
JURY VERDICT: Breach of Master Distributorship Agreement. Scott Sheftall and Brian Torres obtained a jury verdict in federal district court in Miami on behalf of their clients from Kansas City in Global Healthcare Laboratories, Inc., et al. v. Med Gen, Inc., et al. The jury returned a verdict of approximately $2.5 million in damages to compensate two corporate clients for their lost profits resulting from Med Gen's breach of its Master Distribution Agreement. The district court entered judgment in the amount of the damages and reserved jurisdiction to enter a further award to the Plaintiff for attorneys' fees and costs. The case was initially settled after the court entered its judgment, but the defendant breached the initial settlement agreement. After further litigation over the failed settlement, the case was subsequently settled again on better terms for the firms' clients through payments of cash and stock.
SETTLEMENT: Insurer Breaches Agreement with Law Firm. A prominent national law firm retained Sheftall & Torres to bring suit against an insurance company which owed the firm over $200,000 in unpaid attorneys' fees for defending its insured. The law firm's defense of the insured in the complex underlying case was extensive and ultimately successful. Sheftall & Torres alleged that the insurance company without justification had refused to fully compensate the law firm. The insurer contended the law firm had been paid in full. Nevertheless, Scott Sheftall secured a payment to the law firm of $200,000 in a confidential settlement.
SETTLEMENT: Partnership Dispute in Complex Hotel Development. Scott Sheftall represented Peebles Atlantic Development Corporation and R. Donahue Peebles in litigation arising out of disputes between the partners to the Shorecrest and Royal Palm Crowne Plaza hotel development projects in Miami Beach. Cases were pending in both Miami and in Washington, D.C. A confidential settlement was reached.
