Attaining a money judgment through court proceedings may prove to be little more than a pyrrhic victory unless effective measures are undertaken to collect money to satisfy that judgment from all those who may be held legally responsible to pay the debt. More and more, we see would-be judgment debtors and their financial consultants devising both legal and illegal schemes to protect their assets from the judgment liability. On behalf of our clients, we have unraveled sophisticated debt avoidance schemes domestically and internationally, thus preventing individual and corporate judgment debtors, including their relatives, affiliates and subsidiaries, from escaping responsibility for their debts. Let us serve you and your clients whenever post-judgment investigations and litigation appear necessary to collect on your judgments.

NON-JURY TRIAL: Successor Liability for Money Judgment in Proceedings Supplementary. In Miami Center Limited Partnership et al. v. James P. Driscoll, Inc. et al., the firm was lead counsel in proceedings supplementary to execution, which culminated in a week-long trial in February 2006. We established that the sole shareholder of a corporate judgment debtor, as well as that debtor's corporate affiliate, were each the alter egos of the judgment debtor. Additionally, it was proven that the corporate affiliate was the "mere continuation" of the business of the original corporate judgment debtor. On these bases, the Circuit Court entered a final judgment of personal liability against both the sole shareholder and the debtor's corporate affiliate for the full amount of the judgment with interest, for a total liability of over $8 million, including attorneys' fees and costs. The judgment was affirmed on appeal. James P. Driscoll, Inc. v. Gould, 967 So.2d 369 (Fla. 3d DCA 2007).
