NON-JURY TRIAL: Successor Liability for Money Judgment in Proceedings Supplementary. In Miami Center Limited Partnership et al. v. James P. Driscoll, Inc. et al., the firm was lead counsel in proceedings supplementary to execution, which culminated in a week-long trial in February 2006. We established that the sole shareholder of a corporate judgment debtor, as well as that debtor's corporate affiliate, were each the alter egos of the judgment debtor. Additionally, it was proven that the corporate affiliate was the "mere continuation" of the business of the original corporate judgment debtor. On these bases, the Circuit Court entered a final judgment of personal liability against both the sole shareholder and the debtor's corporate affiliate for the full amount of the judgment with interest, for a total liability of over $8 million, including attorneys' fees and costs.
